Now, I received a second hernia repair in 1996. My first was in mid 1990. The second was done with Prolene mesh
which, to my understanding, has been recalled. In the past 2 years (circa 2017), I have experienced “that same familiar
pain” that everyone who has had a hernia is familiar with. Now, from what I’ve been able to find online, there are several
determining factors pertaining to statute of limitations and a “discovery rule, where” the “clock” might start only when the patient discovers (or should reasonably have discovered) that they were harmed by that mistake. For example, let’s say your hernia mesh was implanted on June 1, 2016, but you didn’t begin experiencing complications until December 15, 2017. Under the discovery rule, the statute of limitations “clock” wouldn’t start until December 15, 2017.

Now, considering that it is stated in my surgical report that prolene was used, and the fact that it has been recalled
do I have ANY legal and medical standing for a case?
